TERMS OF SERVICE CW CANDLE CO. LLC Effective Date: November 2025 Welcome to CW Candle Co. LLC (“CW Candle Co.”, “we”, “us”, “our”). These Terms of Service (“Terms”) govern your use of cwcandleco.com and tmlshopgoddess.com (collectively, the “Sites”) and all purchases made through them. By accessing or using the Sites, you agree to these Terms. If you do not agree, do not use the Sites. 1. USE OF THE SITES You must be 18 or older (or the legal age of majority in your jurisdiction) to access or purchase from the Sites. You agree not to interfere with, impair, or attempt to alter the Sites’ functionality, security, or data; impersonate others; commit fraud; upload malware; or violate laws or third-party rights. We may modify, suspend, or discontinue any part of the Sites at any time without notice or liability.

2. USER ACCOUNTS You may create an account for member areas or purchases. You are responsible for maintaining confidentiality of your login credentials and all activities under your account. Provide accurate registration information and update as needed. We may suspend or terminate accounts for violations, false information, or at our discretion without notice.

3. ELECTRONIC COMMUNICATIONS By submitting information, subscribing, placing an order, or interacting with us, you consent to receive communications electronically, including email, marketing messages, transactional notices, and SMS messages (if opted in). Electronic communications satisfy applicable legal notice requirements.

 4. ACCURACY OF INFORMATION You agree all information you provide (billing, shipping, email, account, etc.) is accurate, complete, and current, and that you will maintain updates as necessary. We may suspend or terminate access if information is false or incomplete.

5. PRODUCTS & AVAILABILITY All CW Candle Co. products are intentionally small-batch, hand-poured, artisan creations. Natural variations in color, texture, fragrance intensity, bubble pattern, clarity, or aesthetic finish are expected and not defects. We may modify, discontinue, or limit items, pricing, or availability at any time. Images and product descriptions are illustrative approximations only.

6. PRICING & PAYMENT Prices are in U.S. Dollars and exclude tax and shipping. Payment is due at checkout. We may correct pricing errors at any time and cancel/adjust orders accordingly.

7. GIFT CERTIFICATES Gift certificates are non-refundable, non-transferable, and expire as stated at purchase. Redeemable only on Sites for products. Risk of loss transfers upon electronic delivery. We are not responsible for lost, stolen, or unauthorized codes.

8. SHIPPING & DELIVERY Orders ship via third-party carriers. Delivery timeframes are estimates, not guarantees. Risk of loss transfers upon carrier possession. Address accuracy is the customer’s responsibility. International duties and import fees (if applicable) are responsibility of buyer.

9. RETURNS / REFUNDS Due to the handcrafted and consumable nature of candles, all sales are final except items that arrive damaged or defective. To report: – Email cw@cwcandleco.com within 48 hours of delivery. – Include order number, clear photos of damage, product, and packaging. We may require return for inspection. Approved claims receive replacement or store credit at our discretion. Shipping charges are not refundable.

10. PRODUCT SAFETY Candles are flammable. Use responsibly. Follow all on-product warnings: Burn within sight; keep from flammables, children, pets; trim wick to 1/4"; burn on heat-resistant surface; max 4 hours; stop at 1/4" wax; do not move when lit/hot. Misuse voids liability. Products “AS IS” without warranties.

11. LIMITATION OF LIABILITY To the fullest extent permitted by law: CW Candle Co. LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages (including lost profits, loss of data, or goodwill), even if advised of the possibility. Total liability limited to amount paid for product(s) at issue. Natural variations acknowledged; you assume risks of use. Some jurisdictions limit exclusions; these may not apply.

12. INDEMNIFICATION You agree to indemnify, defend, and hold harmless CW Candle Co. LLC and its affiliates, officers, etc., from any claims, losses, or expenses (including attorney fees) arising from your use of Sites, violations of Terms, or user content.

13. INTELLECTUAL PROPERTY All text, graphics, logos, packaging design, product descriptions, photography, and branding are protected under U.S. and international law. Commercial use, duplication, or reproduction requires prior written authorization.

 14. THIRD-PARTY LINKS We are not responsible for the content or practices of external sites. Use at your own risk.

15. GOVERNING LAW These Terms are governed by the laws of the State of North Carolina, without conflict principles. Disputes exclusively in state/federal courts in North Carolina.

16. UPDATES We may revise these Terms at any time. Updated versions effective upon posting with revised Effective Date. Continued use constitutes acceptance.
